Lambeth & Community Harvest Festival 2013
35th Annual Harvest Festival cancelled due to Alcohol and Tobacco Regulations
At the 2012 Harvestfest event, 2 legal patrons inadvertently and without malice, exited the licensed premises holding purchased beer, without intervention by paid security, and without abiding by posted signage. The individuals incurred no charges, and policing officials elected to charge the volunteer permit holder (Harvestfest), as well as its guarantor personally, on the Special Occasion Permit under the AGCO Act.
Therefore, it is evident that any acts by Harvestfest attendees and the liability of same, lie on the shoulders of those who organize the event and sign the AGCO permit, rather than on an individual who commits an offense under that Act.
In addition, the new City smoking by-law regulations make it unfeasible for organizers to allow smoking at any City facility used for Harvestfest celebrations. The committee must also assume that they would again be held liable and responsible for the actions of any and all individuals who may commit a smoking violation.
In light of the above and under pressure of legal action, the Harvestfest committee is suspending the would-be 35th annual celebration, pending legal outcome.
